Terms and Conditions
The following terms and conditions govern the rights and obligations of LEANBODIES Fitness Centre and Members thereof.

1. The Fitness Centre
LEANBODIES Fitness Centre (LFC) is owned and operated by Health Regime Sdn Bhd (HRSB). HRSB’s principal objective is to provide exercise facilities to LEANBODIES Members and their Guests. HRSB has appointed a Management team (the Management) who are responsible for the operation of the fitness centre in accordance with the LFC Rules which can be amended from time to time.

2. Membership
i. Membership is subject to the LFC Rules in force and may be amended by the Management from time to time.

ii. The Management reserves the rights to decline an application for Membership for any reason whatsoever.

iii. Membership is personal to the Member and is non-assignable, non-transferable and non-refundable. Members are not allowed to enter the fitness facility with another person unless s specifically allowed by the Management via a Free Pass. The use of the Free Pass is covered under the Item 9 – Free Pass.

iv. Upon acceptance, the Member will be thumb printed to allow access to the fitness facility. The Member will be entitled to all the rights and privileges exercisable by the type of Membership for which the Member has been accepted.

a. Membership Types
i) Individual – this membership entitles the Member to all LFC facilities.
ii) Family and Friends – this membership entitles the Members to all LFC facilities. However, members joining must be at least 2 concurrently and at share the same home or office address.
iii) Student – this membership entitles the member to all LFC facilities. However, the member needs to produce a valid Student ID upon registration and will need to be renewed on a yearly basis.
iv) Membership is required for a minimum period of 1 month.
v) Individual below 12 years of age is not allowed to be a member. Individual above 12 years of age but below 18 years old is allowed to become a member only with another adult age 18 years or above as Family and Friend.

b. Membership Fees
i) All Members must pay a minimum of the first month fee, depending on the Membership Type applied. Membership fee is due upon registration and is paid in advance to the month of membership.
ii) Membership fees are subject to change and will be notified to all members by the Management 30 days prior.
iii) Fees can be paid on a monthly, quarterly, half yearly and annual basis either via Online Payment (through MOLPAY ) or manual over the counter payment. (For online payment please see section 14. Online Payments Terms and Conditions and FAQ).
iv) Failure to pay membership fees would result in automatic suspension of the Member. Suspended members are not allowed to use the fitness centre facility.
v) The Management reserves the right to introduce and vary the prices or membership types from time to time.

3. Freezing of Membership
Members may freeze their membership by notifying the Management in writing at least 2 weeks in advance of the period which the membership is to be frozen. The freeze period will begin after the current month membership cycle ends. Fees already paid for the current month membership cycle is not refundable. Any advance fees paid beyond the current month billing cycle will be refunded where requested by members.

4. Termination of Membership
Members may terminate their memberships by notifying the Management in writing at least 2 weeks in advance. The termination will take effect at the end of current month membership cycle ends. Fees already paid for the current month cycle is not refundable. Any advance fees paid beyond the current month billing cycle will be refunded within 30 days of the effective termination date.

5. Activating Membership
Members who have been suspended or frozen may activate their membership by paying the monthly membership fees again. Members who have terminated their memberships will need to register as a new member again.

6. Limitation of Liability
In consideration for the Management accepting the Member’s application for Membership of LFC and for the Member to becoming and remaining as a Member of LFC, the Member hereby agrees:

i) Neither LFC, its associated companies, employees or agents shall be responsible for any claims, demands, injuries, damages or actions for negligence arising on account of death or due to injury, loss, damage or theft to a Member’s person or property arising out of or in connection with the use by a Member of any services, facilities or premises of LFC. The Member hereby holds HRSB, its associated companies, employees and agents harmless from all claims which may be brought against them by or on a Member’s behalf for any such claims aforesaid.

ii) Any guest of a Member or temporary visitor to LFC agrees to abide with LFC rules and the same limitation of liability as a Member.

7. Physical Condition of a Member
i) The Member warrants that he/she is in good physical condition and that he/she knows of no medical or other reason why he/she is not capable of engaging in active or passive exercise and that such exercise would not be detrimental to his/her health, safety, comfort or physical condition.
ii) The Member shall not use any LFC facilities whilst suffering from any infections or contagious illness, disease or other ailment such as open cuts, abrasions, open sores or minor infection, where there is a risk such use may be detrimental to the health, safety, comfort or physical condition of the other Members.

8. Expulsion of Members
i) The Management reserves the right to terminate the membership of any Member:

a) Without notice and with immediate effect if the Member’s conduct, whether or not such conduct is the subject of complain by another Member or Members, is such that in the reasonable opinion of the Management, it may be injurious to the character or interest of LFC.
b) Without notice and with immediate effect if the Member shall have committed an breach of these Terms and Conditions as from time to time in force.
c) If any Membership monthly fees or any other service fees remain unpaid after due date for payment.
d) Upon notice in writing, if the Management is of the opinion that the Member is not suitable for continued membership of LFC.

All decisions by the Management under this clause are final and binding.
ii) A Member whose membership is terminated by the Management shall forfeit all the privileges of membership with immediate effect without claim of any refund of his/her paid fees other than fees paid in advance. On termination of his/her membership, the Member must pay all outstanding fees owed to HRSB.

9. Guests
i) Members introducing Guests shall ensure their Guests bring in a Free 1 Day Pass or pay the current Guest Pass fee (where applicable) to use the facilities.
ii) Guests will enjoy the same privileges given to Members and are subject to the same Fitness Centre Rules.
iii) The Management reserves the right to exclude any Guest from LFC without giving any reason and may regulate Guest Passes or pricing for Guests from time to time.

10. Gymnasium
i) All Members are to undertake a Body Composition Measurement and Fitness Evaluation prior to a fitness program conducted by a Fitness Trainer.
ii) All Members and guests are required to wear proper gym attire when exercising. A top is required to cover the chest area, no torn clothing items are permitted. Closed toe, non-marking rubber soled shoes are required at all times in the gymnasium and in the aerobics room. Members should be considerate of other members and wipe down equipment with hand towel after use. Members should also not dominate specific equipment during busy hours.
iii) Fitness instructors are authorized to stop anyone from exercising if he/she is judged unsafe. Users must abide by the instructions of the fitness instructors.

11. Lockers
i) Lockers are available for free in the respective Men and Women changing areas. Members need to bring his/her own padlocks to secure the locker during exercise time. Members are not allowed to leave anything in the lockers after leaving the fitness centre.
ii) Management accepts no responsibility for loss or damage to the items kept by members in the lockers for any reason whatsoever during exercising.

12. Others
i) Lost property, if return to the Management, will be held for a period of 3 months after which the Management reserves the right to dispose of the items in any way it sees fit. No claims shall be entertained after this period.
ii) The Management may from time to time wish to show potential Members or others around the fitness centre and allow them to use the facilities on a trial basis and reserves the right to do so.
iii) The fitness centre operates 24 hours. However, there may be occasions where the facility may need to be partially or fully closed during certain hours of the day to do repair, cleaning or upgrading work. The Management shall endeavour to give reasonable notice period to Members of any shortening of normal operational hours.
iv) Smoking is not permitted anywhere in the facility as well on the pathway in front of the facility.
v) Members are not allowed to bring alcoholic beverages into the facilities.
vi) Members or Guests are not allowed to use any equipment in the facility whilst under the influence of alcohol, narcotics or any other mood influencing substances.
vii) Members are not permitted to wear outside shoes in the changing areas. Members are to use sandals provided by Management in the changing areas.
viii) The failure of the Management to enforce any of their respective rights at any time for any period shall not be construed as a waiver of such rights.
ix) The Management may at its sole discretion amend, vary, delete or add to these Terms and Conditions with immediate effect. Members will be advised of any changes by notification via email, newsletter or notice board in the facility.
x) These rules shall be governed and constructed in accordance with the laws of Malaysia and subjected to the jurisdiction of Malaysia.

13. Privacy Policy
i) All personal information of members collected will only be used in some or all of the following ways:
- To deliver email confirmation of your membership status
- To update you on any promotional campaigns and newsletter from time to time
ii) LFC ensures that members personal information are not shared with anyone outside the company.

iii) LFC ensures that all personal information collected from members will be safely and securely stored. LFC protects members’ personal information by:

- Restricting access to personal information.
- Maintaining technology products to prevent unauthorized computer access.
- Securely destroying members’ personal information when it’s no longer needed for our record retention purposes.

14. Online Payment Terms and Conditions

i) All online payments will be made via our online payment solution provider MOLPAY.
ii) MOLPAY is an internet switching gateway through credit cards, internet banking (e-debit). It is the same Online Payment Gateway System currently provided by many licensed Financial Institutions. For that reason, members can be certain of MOLPAY security. MOLPAY also complies with PCI Data Security Standard and Malaysia Payment System Act.
iii) As LFC uses MOLPAY as a gateway for online payments, MOLPAY’s Terms of Service forms part of this Terms and Conditions.
iv) MOLPAY name will be shown on cardholders’ statement.
